Welcome to Episode 9 of our podcast, where we continue to provide trusted insights for property buyers in the Southern Highlands. In this episode, Paul Denny from Bowral Conveyancing Centre explores the complexities of buying property off the plan and the unique risks buyers need to consider.
Paul explains why researching both the developer and the builder is one of the most important steps before signing anything, sharing how past defects and unfinished projects can leave buyers exposed. He also breaks down two critical contract clauses: the sunrise date, which allows a developer to cancel if work hasn’t commenced by a set deadline, and the sunset date, which dictates the timeframe for completion and when a buyer can withdraw if delays drag on.
Drawing on real-world examples, Paul shows how projects can face setbacks, including builders going broke, and why these contractual protections are essential to understand. With 46 years of conveyancing experience, he highlights how expert advice can help buyers avoid costly pitfalls and make informed decisions when purchasing off the plan.
If you’re considering buying into a new development, this episode is a must-listen to ensure you know the risks, the fine print, and the questions to ask before you commit.

Paul highlights the risks and realities of buying off the plan. Here’s what you’ll learn from this episode:
Developer vs Builder – They are not the same party. Researching both reputations is crucial to avoid shoddy workmanship or unfinished projects.
The Sunrise Date – A clause allowing developers to cancel contracts if construction hasn’t started by a specified date.
The Sunset Date – A clause setting the final deadline for project completion, after which buyers may walk away if delays persist.
Project Risks – Builder insolvency, DA approval delays, and financing issues can all significantly impact timelines.
Buyer Protections – Understanding how these clauses operate helps buyers avoid being locked into lengthy delays or stalled projects.
The Role of Expert Advice – Conveyancers like Bowral Conveyancing Centre review contracts, identify risks, and protect buyers’ interests before they commit.

Paul Denny is far from your average conveyancer. With a career spanning over four decades, Paul has established himself as a trailblazer in the industry. Starting his career in South Australia in 1978, Paul had early exposure to working alongside solicitors, gaining hands-on experience in the conveyancing landscape.
When legislation finally allowed the licensing of conveyancers in New South Wales in 1993, Paul didn’t hesitate to relocate and become the first licensed conveyancer in the state. From that moment, he made it his mission to deliver exceptional service, simplify property transactions, and help clients achieve their real estate goals.
After years of managing a successful practice in Sydney under the Paul Denny Conveyancing name, Paul took a step back from running a large organisation. However, his love for conveyancing led to the creation of Bowral Conveyancing Centre, a boutique service dedicated to the Southern Highlands community.
